IHH Healthcare (KLSE:IHH) said India's Supreme Court on Sept. 25, Friday, disposed of Fortis Healthcare's (NSE:FORTIS, BOM:532843) Special Leave Petition challenging a Delhi High Court order requiring a forensic audit of Fortis and certain observations concerning the company.
The company's unit, Northern TK Venture, acquired a 31% stake in Fortis in 2018 through a competitive bidding process, involving a 40 billion rupees preferential allotment and a mandatory tender offer to public shareholders.
IHH said the acquisition was completed months after former Fortis promoters Malvinder and Shivinder Singh had resigned from the company's board in March 2018. It said no secondary shares were acquired from them and no payments were made to them, adding that it was not a party to the dispute between Daiichi Sankyo and the former promoters.
The healthcare company said it will cooperate fully with the forensic audit and remains committed to Fortis, with plans to increase its stake to 51% over the next three to five years.
